These Privacy Policies (“Policies”) apply when you use a website, mobile application, or other online services of AiArtFace (collectively, the “Services”). This Privacy Policy is part of, and is governed by, the terms and conditions set forth in our Terms of Use, which are a legal contract between you and HONGKONG LINKV CORPORATION LIMITED (“AiartFace”, “we”, or “us”). These Privacy Policies describe how we handle user information collected when you use the Service. By accessing or using our Service, you agree to be bound by these policies referenced herein. Please read the Terms of Use and these Privacy Policies carefully before you use our Services. If you do not understand these Policies or do not accept any part of them, please do not use our Services.

1. Information we collection

1.1 When you use our Service, we collect the information that you provide us directly.

1. Photos. We may collect the photos when you upload from your devices while using the Service.
2. Registered information. We may collect the email address or a third-party platform account to register on the Service and create an account. When you create an account, we may collect the personal information you provide to us, such as your name, gender, date of birth, username, password, email address, phone number, and so on.
3. Communication information. We may collect the information contained in your message, which may include your name, contact details and any other personal information you provide when you contact us with questions, concerns or for purposes of customer/technical support. We may collect some personal information, such as your email address, name, and other information provided by you when you communicate your opinions or inquire about our service via our feedback channel.

1.2 When you access and use the Service, we may automatically collect certain details of your access to and use of the Service.

1. Usage Detail. These details include the IP address, logs, and the resources that you access and use on or through the Service.
2. Device Information. We may collect information about your mobile device and internet connection, such as the unique device identifier, operating system, browser type, and mobile network information.
3. Geo-location data. We may collect Geo-location data if you choose to share it with us so that we provide the content sharing Service to you.
4. Cookies & similar technologies. We may collect the Cookies to collect information about your interactions with our Service.

2. How We Use Your Information
   1. We use your photos:

In order to implement the composition of the personalized art styles effect, we may analyze the photos you upload to get some features, and apply the features to the template and composition of the personalized art styles effect. The original photo you upload, the features data and the final generated art styles effect picture will be temporarily stored in encrypted storage and will be permanently deleted after a certain period of time.

2.2  We use your information other than photos to:

1. To provide the Services to you, we need to use or share certain information about you with our third party providers or partners to the extent necessary.
2. To keep you updated of the Services, or to notify you of necessary information about the Services, we will use your contact information to communicate with you. Service-related communications are not promotional in nature. You cannot unsubscribe from such communications because you could miss important developments relating to your account or the Services that may affect how you can use our Services.
3. To help you with any questions, concerns, disputes or issues, or to provide us with your feedback.
4. To enforce our terms of use and to comply with our legal obligations.
5. To improve and enforce our security measures; combat spam, malware, malicious activities or security risks; and to monitor and verify your identity so that unauthorized users do not access your account with us.
6. To personalize your experience on our Services via social media plugins on our Services (e.g., Facebook, Google, Instagram, Twitter, etc.), by keeping track of your preferences (e.g., nickname or display name, time zone, language preference, etc.), and more.
7. To help us improve our Services, build new Services, and build customized features or Services, and train our models. Such processing ensures your continued use of part or all of our Services.
8. To send marketing communications to you or your friends when you share your friend's contact information with us. You can unsubscribe from marketing communications at any time.

 

If we decide to change the purpose of processing specified above, we will inform you of such changes prior to using your personal information within the newly set purpose and ask for your separate consent if required by the applicable laws.

3. What permissions do we may ask you to authorize

In order to provide you with better and more efficient products and services and improve your service experience, we may request you to authorize the corresponding terminal device permissions. With your consent, we collect the following permissions and corresponding information in accordance with the minimum data collection standards:

Android permission application:

• Camera permission: for shooting functions;

• Read and Write external memory cards: for reading and writing files on external memory cards for photo editing or video editing;

• Receive notification messages: used to receive messages;

• Get the current network status: remind the user whether the device network is currently in use or determine whether the user’s network is available;

• Advertising ID: collects the device advertising identifier for personalizing advertising content;

•  Location Access: for the general location of your mobile device.

IOS permission application:

•  Camera permissions: for shooting functions;

•  Photo permission: used to read pictures in the mobile phone album for video editing;

•  Recording permission: used for shooting function;

•  Push notification permission: for receiving messages;

•  Network request permission: used to request network data;

•  Privacy Tracking Permission: Collect Device Advertising Identifier IDFA for personalizing advertising content;

•  Location Access: for the general location of your mobile device.

You can check the status of the above permissions in the system settings of the terminal device, and you can turn on or off any or all of the above permissions at any time at your own discretion. Please note that when you turn on any permission, you authorize us to collect and use the personal information corresponding to the permission in order to provide you with the above corresponding services. Once you turn off any permission, it means that you cancel or revoke the authorization of the permission, and we will no longer continue to collect and use the corresponding personal information based on this permission, and we will not be able to provide you with services corresponding to this permission. However, your decision to turn off permissions will not affect the collection and use of information in accordance with your previous authorization.

4. How we share your information

4.1 We may share your necessary personal information with third-party service providers to help us deliver and improve products, services, marketing, push/delivery notification bar messages, and to help you share content to third-party media websites, by logging into third-party accounts and other legitimate business functions. We will confirm on what basis each third party will use your personal information and we will ensure that adequate safeguards and processes are in place to protect your personal data.

4.2 We will disclose or transfer your information only if required to do so by law, or we have obtained your consent, or in good faith that any such action is necessary to:

1. comply with any legal requirement or comply with us or platform services;
2. protect and defend our rights or property;
3. take action in an emergency to protect the personal safety of our users or the public.

4.3 In order to ensure the realization of relevant functions and the safe and stable operation of applications, we may access software development kits (SDK) provided by third parties to achieve relevant purposes. We will conduct strict security monitoring on the software tool development kits (SDK) used by partners to obtain information to protect data security. The relevant third-party SDK we access are listed in this privacy policy. Please note that the third-party SDK may change their data processing types due to their version upgrades, policy adjustments, etc., please refer to the official instructions published by them.

3. Google ml sdk - Face detection (https://developers.google.com/terms/api-services-user-data-policy),which recognizes and locates facial features, get the contours of facial features, recognize facial expressions, track faces across video frames, and process video frames in real-time.

5. International Transfer

Your Data may be transferred to, and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction. Your consent to this Policy followed by your submission of such Data represents your agreement to that transfer.

6. Information Security

We use industry-standard security tools, and measures, as well as internal procedures and strict guidelines to prevent information misuse and data leakage. Our employees are subject to confidentiality obligations. We will do our best to reduce the risks of data misuse, but we cannot guarantee that our systems will be absolutely safe. If you become aware of any potential data breach or security vulnerability, you are requested to contact us immediately. We will use all measures to investigate the incident, including preventive measures, as required.

7. Your Rights as the Data Subject

Pursuant to applicable Law, you may request the following regarding your personal data via our feedback channel:

• Learn whether or not your personal data have been processed;

• Whether or not your data have been processed;

• Learn the purpose of the processing of personal data and whether data are used in accordance with their purpose;

• Know the third parties in the country or abroad to whom your personal data have been transferred;

• Request deletion, destruction or anonymization of personal data if the reasons for the processing have disappeared and request notification of the transactions made under this scope to third parties to whom personal data have been transferred;

• Object to occurrence of any result that is to your detriment by means of the analysis of personal data exclusively through automated systems;

• Request compensation for the damages in case you incur damages due to unlawful processing of your personal data. 

Where General Data Protection Regulation (GDPR) is applicable, data subjects have the following rights:

• Right of access - Learning whether personal data is being processed and, if so, accessing your personal data and the information regarding the processing of your personal data;

• Right to correction - To request the correction of information that you believe is inaccurate or the completion of information that you believe is incomplete by AiartFace;

• Right to delete - To request deletion of personal data under the conditions stipulated in GDPR;

• The right to restrict processing - To request the restriction of the processing of personal data under the conditions stipulated in the GDPR;

• Right to object to processing - To object to the processing of personal data under the conditions stipulated in the GDPR;

• Right to data portability - To request the data collected by AiartFace to be transferred directly to another organization or under certain conditions;

• Objection to the occurrence of a result against the person himself/herself, by analyzing the processed data exclusively through automatic systems, including profiling.

In the application that includes your explanations about the right you have as the data subject and exercise your rights stated above and that you request to exercise; Your request must be explicit and understandable, if the subject of your request is related to you or if you are acting on behalf of someone else, you must be specially authorized in this regard and your authority must be documented, the application must contain identity and address information and documents proving your identity must be attached to the application. You can make such a request by contacting us as described in the “Contact to US” section.

8. Privacy of Children

We do not collect personal information from children under 14 years since they are not permitted to use our Services. We do not knowingly collect personal information from children under 18 years old unless they provide us with consent from the supervision of a parent or legal guardian. If we become aware that we have unknowingly collected personal information from a child, we will make commercially reasonable efforts to delete such information in our database. If you are a parent or guardian of a child, and you believe your child has provided us with their Personal Information from our Services, please contact us immediately as described in the “Contact to US” section.

9. Changes to Our Privacy Policy

We may change the terms or modify any features of the Policies at any time at our sole discretion. Thus, you are advised to review this page periodically for any changes. If you continue to use the Services after changes are posted you will be deemed to have accepted the change.
